Court of Appeal Affirms Chico Unified’s Victory in Defeating a Developer Fee Challenge

On November 5, 2020, the Third Appellate District published its opinion in AMCAL Chico, LLC v. Chico Unified School District (C087700) affirming the trial court judgment obtained by our firm on behalf of Chico USD.  This case is the first published opinion in California stating that so-called, off-campus “college student housing” apartments are subject to residential developer fee assessments by a school district.  The opinion affirms the important right of school districts to assess fees on new residential development, even if developers initially market those apartments to college students.
